Q: Who is responsible for the upkeep of lawns and gardens
at Ruby Gardens?
A: Resort Management is responsible for maintaining lawns at the front of all homes
and street areas as well as the gardens in the common areas and around the Country
Club.
Residents are responsible for the maintenance of any yards to the rear or sides
of their site.
Q: Am I entitled to Government Rent Assistance?
A: If you are on a pension or benefit from Centrelink or Veterans Affairs,
then you may be entitled to receive rent assistance. Please contact the relevant Government
Departments to verify your eligibility. Resort Management is unable to discuss eligibility requirements
with you.
Q: Can I keep my caravan, trailer or boat at Ruby Gardens?
A: Yes. Storage is however subject to the availability of space.
Q: Am I allowed to have visitors stay with me for a short period?
A: Yes. Family and friends are always welcome to visit you. However, additional fees can apply if any more than two people
occupy your home on a long term or permanent basis. Children must be supervised at all times.
Q: Can I sell my home at Ruby Gardens to someone else?
A: Yes. You are able to sell your home, or if you wish, leave it to a beneficiary in your will. You may elect to sell your home
at any time. Note however that future owners of your home must agree to be bound by a Site Agreement.
Q: Are the homes at Ruby Gardens able to be purchased by investors?
A: No. Only those people who intend to be owner occupiers may purchase homes
in this community. Ruby Gardens does not offer rental accommodation.
Q: How long will it take to complete the construction of my new home?
A: Your new home at Ruby Gardens will be built using the latest construction technology.
You can expect to be living in your new home within approximately 10 – 14 weeks from the
commencement of construction.
Q: Is my home guaranteed?
A: Yes. Every home at Ruby Gardens is covered by a statutory structural guarantee which spans a period of
six years and six months. This guarantee provides you with additional peace of mind.
Q: Do I receive title to my home?
A: Absolutely. Immediately upon making your final progress payment, you will receive a Certificate of Ownership as
confirmation of your investment at the Resort.
Q: Is my home treated for termites?
A: Yes. Every home and every site at Ruby Gardens is treated for termites in accordance with local authority policy and
Australian Standards. All residents are however required to fumigate their homes once every year.
Q: Can I have a pet?
A: Yes. We appreciate your pet is part of your family and they are welcome with prior approval from Resort Management.
Note there is a pet policy which must be adhered to.
Q: Do I own my own home at Ruby Gardens?
A: Yes. One of the main reasons why life at Ruby Gardens is so affordable is that we have
separated the ownership of the land from the ownership of the home. When you buy a home at
Ruby Gardens you also enter a Site Agreement over the land upon which your home is to be situated.
Although you do not own the land, your right to live in your home at Ruby Gardens is guaranteed and
protected by law for an indefinite period of time.
Q: Do you have to be retired to live at Ruby Gardens?
A: No. Ruby Gardens is designed for the over-50’s (especially those young at heart) whether retired or not.
Q: How do I secure my site at Ruby Gardens?
A: It’s easy! A $500.00 fully refundable holding deposit will give you a conditional first option hold on your preferred site.
You are able to request a full refund of your holding deposit at any time.
Q: What happens when I enter an unconditional building contract?
A: Once you express your desire to enter an unconditional building contract, Resort Management will invite you to select your
preferred site, home design and list of inclusions.You will then be presented with a schedule detailing the cost of your new home.
If you are happy with the price, then you will be requested to enter a standard building contract for the construction of your
new home and pay a further sum of $4,500.00.
Q: What is the duration of my Site Agreement?
A: Your Site Agreement does not have an expiration date and can only be ended by mutual agreement between you and the
owner of Ruby Gardens or by an order of the Commercial and Consumer Tribunal. The owner of Ruby Gardens can never
unilaterally terminate your Site Agreement.Your right to live and enjoy the facilities on offer at Ruby Gardens is protected
by law.
Q: What is Ruby Gardens Lifestyle Resort?
A: Ruby Gardens Lifestyle Resort is the latest Active Lifestyle Resort created by Living Gems.
As is the case with each of our establishments, Ruby Gardens has been purpose built and designed
for people over the age of 50 who intend spending their golden years in style within an exclusive,
five star community environment.

Q: Where is Ruby Gardens located?
A: Situated at the ‘gateway to the Gold Coast,’ Ruby Gardens has been strategically located close to South-East Queensland’s
major medical, shopping and entertainment precincts.
Access to Ruby Gardens is via the four-lane M1, which can whisk residents off to the sandy beaches of Surfers Paradise
or the big city lights of Brisbane in less than 30 minutes.
Q: What facilities are provided at Ruby Gardens?
A: Ruby Gardens boasts arguably the finest Resort facilities currently on offer in any contemporary over-50’s Resort.
Available for exclusive use to all residents is a world class Country Club incorporating a huge huge Grand Ballroom and a
range of common area facilities previously mentioned. Ruby Gardens also provides plenty of manicured green areas and wide
thoroughfares for those residents who enjoy early morning walks or are otherwise in touch with nature. The Resort is also
surrounded by environmental reserves and local wetlands.
Q: Does Ruby Gardens have on-site management?
A: Yes. Unlike many other over-50’s Resorts, Residents at Ruby Gardens enjoy the presence of experienced and hard working
on-site management. Our resident managers administer the day-to-day operations of the Resort.
